As a landlord in Carlsbad, you want to avoid tenant evictions whenever possible. If you have an otherwise responsible tenant in place who is struggling to make the rent one month, it’s a good idea to work something out with that tenant. Landlords don’t want to incur the expense of an eviction and tenants don’t want to lose their home.

Set Up a Payment Schedule

Everyone understands that people can fall on hard times, and things can happen that make feeding a family and paying the rent difficult. If you find yourself in a lease with a tenant who isn’t able to pay the rent, we recommend that you come up with a payment schedule that will work for both parties. For example, maybe the tenant can bring you $500 the first week of the month, and then catch up with the balance of what’s owed later. You don’t want to do this every month, but if it’s a first offense for a good tenant and not a chronic issue, we advise you to work with people.

Serve the Three Day Notice

When you receive that first $500 payment, service the tenants a Three Day notice to Pay or Quit. Ask when you can expect an additional payment. Maybe it will be another $500 the following week. When the tenants come back to make that payment, you need to serve another Three Day Notice. That way if they don’t fulfill their end of the bargain, you are prepared and ready to take them to the eviction attorney. Every time you accept money from them, you need to serve a Three Day Notice to Pay or Quit based on the new amount that’s due.

There are several strategies you can use to avoid eviction and work with people. Find something mutually beneficial so you can avoid eviction whenever possible.
